Neural Tube Defects

Neural Tube Defects Common in Newborns Whose Mother's Took Paxil During Pregnancy

Neural tube defects are birth defects involving the brain and spinal cord. There are two common neural tube defects: spina bifida and anencephaly. With spina bifida, the spinal column of the fetus does not close completely during the first month of pregnancy. Usually this is accompanied with nerve damage causing some paralysis of the legs. With anencephaly, much of the brain does not develop. Unfortunately, fetuses with anencephaly are either stillborn or die shortly after birth. In December 2005, the U.S. Food and Drug Administration (FDA) issued a public health advisory that warned of the increased risk of birth defects with Paxil use in pregnancy. Neural tube defects are birth defects associated with the use of Paxil during pregnancy.

Two New England Journal studies have associated several types of birth defects with the use of Paxil. One such example is neural tube defects which occur in the neural tube, a sheath that folds and closes between the third and fourth weeks of pregnancy forming the brain and spinal cord of the embryo. Neural tube defects can be classified as:

  • spina bifida
  • lipomyelomeningocele
  • tethered cord
  • encephalocele
  • anencephaly
  • lipomeningocele

Why You Should Consult a Paxil Attorney

The importance of consulting with a Paxil attorney is paramount because they can act as a guide through the certain legal mazes that Paxil manufacturers will try to create during any litigated case. They can provide solid evidence in a court room to make sure you are given a fair chance at trial. There is a unique risk for pregnant women using Paxil. This medication is the only SSRI on the market that the FDA classifies as a Category D drug. Category D means that studies in pregnant women have shown risk to the fetus. The stunning results of two studies showed that when Paxil is taken during the first three months of pregnancy women were about one and a half to two times more likely to have a baby with a birth defect like neural tube defects as opposed to women who consumed other antidepressants or other women in the general population. A Paxil attorney will drive these points home with a jury to make sure you are given the compensation you so rightfully deserve.

Paxil Is Now Known To Be A Possible Cause Of Neural Tube Defects In Babies

[Posted on Feb 01]

It’s been revealed in recent years that neural tube defects in newborns are among the health problems that are linked to use of the medication Paxil by a mother during pregnancy. This was prior to official warnings made by the FDA in 2005 that finally confirmed the research which indicated women who are pregnant or plan on becoming pregnant should not take Paxil. But those FDA warnings about Paxil birth defects came over a decade after the drug had first been released and regularly prescribed to women so there are numerous instances of children with neural tube defects.

Those cases should have been avoided had GlaxoSmithKline been more proactive with their warnings even if they were unsure about the validity of the research that was being released. It would have been better if they’d chosen to be safe rather than sorry but instead they caused tremendous amount of pain to be felt by the families of children with neural tube defects like spina bifida and anencephaly. This has led to a number of Paxil lawsuits being filed and subsequently won against GlaxoSmithKline.

Courts across the country have ruled against GlaxoSmithKline and in favor of families that have given birth to a child with neural tube defects that were caused by Paxil. This is serving as proof to other victims that they can take action against a large corporation like GlaxoSmithKline and be successful. But not all of these Paxil pharmaceutical lawsuits have led to financial compensation for victims. Those that fail to hire qualified legal representation find that the lawyers of GlaxoSmithKline are often able to dismiss their cases before they even get to court.

While many lawyers will claim they can serve as a Paxil attorney, they don’t always have the background and experience that’s needed to do the job. If you’re considering a prescription drug lawsuit against GlaxoSmithKline, you should avoid these kinds of lawyers. Few firms in the country have been as consistently successful in Paxil lawsuits as the Law Offices of Chandler, Mathis, & Zivley, PC. You can receive a free legal consultation with a Paxil attorney from Chandler, Mathis, & Zivley if you believe you’ve got a prescription drug lawsuit that should be filed. This consultation will give you advice that you can trust from an experienced and credible Paxil attorney who can accurately assess the strength of your case and then provide advice on how to move forward if legal action is warranted.
